This Privacy Policy explains how PitchGenius AI ("PitchGenius," "we," "us," or "our") collects, uses, discloses, and protects personal information when you access or use our website, platform, AI tools, and related services (the "Services"). It also describes your rights and choices regarding your personal information.

By using the Services you acknowledge that you have read and understood this Privacy Policy. If you do not agree, please do not use the Services. This Policy should be read together with our Terms of Service.

1. Who We Are and Scope

PitchGenius AI provides AI-powered sales psychology and buyer-intelligence tools. This Policy applies to personal information we process in connection with the Services. It does not apply to third-party websites or services that we do not control, even if linked from our Services.

For the purposes of the EU General Data Protection Regulation (GDPR) and similar laws, PitchGenius is the controller of personal data we collect directly from you (account data, usage data, billing information). With respect to any personal data of third parties (e.g., prospective buyers, LinkedIn profile data, or contact details) that you upload or provide to the Services, you are the controller and PitchGenius acts as a processor / service provider on your documented instructions.

2. Information We Collect

2.1 Information You Provide Directly

  • Account and profile information (name, email address, company name, job title, password or authentication credentials).
  • Billing and payment information (processed by our payment processor; we do not store full card numbers).
  • Content you submit to the Services ("Inputs"), which may include LinkedIn URLs, email addresses, names, notes, call transcripts, scripts, or other information about prospective buyers or your business.
  • Communications with us (support requests, feedback, survey responses).

2.2 Information Collected Automatically

  • Usage and log data (IP address, browser type, device information, pages viewed, features used, timestamps, referring URLs, error logs).
  • Cookies and similar technologies (see Section 8).
  • Approximate location derived from IP address.

2.3 Information from Third Parties

We may receive information from authentication providers (e.g., Google or Microsoft single sign-on), payment processors, analytics providers, and (if you choose to connect them) CRM or other integrations. We do not independently scrape LinkedIn or other platforms for buyer data on your behalf beyond what is necessary to process the Inputs you explicitly provide.

3. How We Use Your Information

  • To provide, operate, maintain, and improve the Services, including generating AI profiles, scripts, and recommendations based on your Inputs.
  • To process transactions, send invoices, and manage subscriptions.
  • To communicate with you about the Services, security alerts, product updates, and (with your consent where required) marketing.
  • To detect, prevent, and address fraud, abuse, security incidents, and technical issues.
  • To comply with legal obligations and enforce our Terms of Service.
  • To create aggregated or anonymized data that does not identify you or any individual, which we may use for analytics, research, and product improvement.

AI Processing and Model Training: Your Inputs are processed by AI models (which may include third-party foundation models operated by subprocessors) to generate Outputs. We do not use your Inputs or Outputs to train, fine-tune, or improve general foundation models without your explicit prior consent. We may use aggregated, de-identified, or anonymized data derived from use of the Services to improve the overall quality and performance of our own systems.

4. Legal Bases for Processing (GDPR / UK GDPR)

Where the GDPR or UK GDPR applies, we process personal data on the following legal bases:

  • Performance of a contract (providing the Services you requested).
  • Legitimate interests (improving the Services, security, fraud prevention, analytics) balanced against your rights.
  • Consent (where we request it, e.g., certain marketing or optional features).
  • Legal obligation (compliance with applicable laws).

5. How We Share Information

We do not sell your personal information. We may share information in the following circumstances:

  • Service Providers / Subprocessors: Cloud hosting, payment processing, analytics, email delivery, customer support, and AI model providers that process data on our behalf under contractual obligations of confidentiality and security. A current list of material subprocessors is available upon request or will be published on our website.
  • Business Transfers: In connection with a merger, acquisition, financing, reorganization, or sale of assets.
  • Legal Requirements: When required by law, subpoena, or governmental request, or to protect the rights, property, or safety of PitchGenius, our users, or the public.
  • With Your Consent or Direction: When you instruct us to share information or connect third-party integrations.

6. International Data Transfers

PitchGenius is based in the United States. Personal information may be transferred to, stored in, and processed in the United States and other countries that may have data-protection laws different from those in your country of residence. Where we transfer personal data from the EEA, UK, or Switzerland to countries that have not been deemed adequate, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses (SCCs), the UK International Data Transfer Agreement / Addendum, or other lawful transfer mechanisms. You may request a copy of the relevant safeguards by contacting us.

7. Data Retention

We retain personal information for as long as necessary to provide the Services, fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, and enforce our agreements. Account data is generally retained for the life of the account plus a reasonable period thereafter. Inputs and generated Outputs may be retained for the duration of your subscription and for a limited period after termination to allow export or to comply with legal holds. You may request deletion of your account and associated personal data subject to our legal retention obligations.

8. Cookies and Similar Technologies

We use cookies, pixels, and similar technologies to operate the Services, remember preferences, analyze usage, and (where permitted) support marketing. You can control cookies through your browser settings. Disabling certain cookies may limit functionality. We may use first-party and third-party analytics tools; their use of information is governed by their own privacy policies.

9. Your Privacy Rights

Depending on your location, you may have the following rights regarding your personal information:

  • Access / Know what personal information we hold about you.
  • Correction / Rectification of inaccurate data.
  • Deletion / Erasure ("right to be forgotten") subject to legal exceptions.

No method of transmission or storage is 100% secure. You are responsible for maintaining the security of your account credentials.

11. Children's Privacy

The Services are not directed to individuals under 18 years of age. We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child, we will take steps to delete it.

12. Third-Party Links and Integrations

The Services may contain links to third-party websites or allow integrations with third-party services (e.g., CRM platforms). We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies.
